On July 1, 2026, California consumers sued Albertsons, Walmart, Sam’s Club, 7-Eleven, Circle K, Marathon Petroleum, BP, and other fuel retailers in the U.S. District Court for the Eastern District of California, alleging an illegal, algorithmic price-fixing scheme built on Kalibrate’s AI fuel-pricing software. The suit claims the tool, which analyzes competitors’ pump prices and recommends adjustments, inflated gasoline prices by a mean of about 6 cents per gallon in areas using the technology and by as much as 30 cents per gallon where adoption was heaviest, in violation of California’s Assembly Bill 325 restricting shared algorithmic pricing among competitors.
