The lead plaintiff, who never used Otter’s service himself, alleges a February 2025 sales call was recorded by another participant’s Otter Notetaker bot without his consent, with the audio sent to Otter’s servers and used to train its speech-recognition models. Claims under the federal Wiretap Act, the California Invasion of Privacy Act, and the Illinois Biometric Information Privacy Act were allowed to move forward, while claims under the Computer Fraud and Abuse Act and Washington’s privacy law were dismissed with leave to amend.
