Daniel Swanson, a former IBM software development manager terminated in September 2024 as part of a company “Resource Action,” applied for an open product manager role in February 2025 and received an automated rejection two days later that his complaint says was generated by artificial intelligence screening software. Swanson alleges the rejection is the latest step in a long-running effort to replace older employees with younger “Early Professional Hires,” violating federal and Texas age-discrimination law. The lawsuit, filed in the U.S. District Court for the Western District of Texas, seeks back pay, reinstatement, and a jury trial. IBM has denied using AI to automatically screen out candidates.
