U.S. Senate negotiators, including Sens. Amy Klobuchar, Ted Cruz, and Majority Leader John Thune, are drafting bipartisan legislation that would impose a legal ‘duty of care’ on developers of the most advanced AI models. The bill would let the federal government block release of AI models deemed to pose catastrophic risks, such as aiding biological or nuclear weapons development, while giving companies the ability to challenge such decisions in federal court. It would apply only to top-tier developers such as Google, Anthropic, and OpenAI, and reportedly would preempt certain state AI regulations.
