The USPTO’s Office of Enrollment and Discipline issued its first-ever AI-predicated discipline order after California patent attorney Brian E. Mitchell used generative AI to draft a claim-construction chart in patent litigation between Magpul Industries and Mission First Tactical Group. The AI tool invented citations to non-existent portions of the patent’s specification, drawings, and prosecution history, and a second AI tool used to review the draft failed to catch the errors. Mitchell received a public reprimand for violations of competence, diligence, and misrepresentation; no monetary sanctions were imposed and the underlying case later settled.
