Two job applicants sued Eightfold AI, Inc. in California’s Contra Costa County Superior Court on January 20, 2026, alleging the AI hiring platform — used by employers including Microsoft, PayPal, Morgan Stanley, Starbucks and Chevron — compiled hidden, credit-report-like profiles on candidates from social media, location and device-tracking data without complying with the Fair Credit Reporting Act. The complaint alleges Eightfold scores applicants’ likelihood of job success using these profiles but gives candidates no way to see, correct or dispute the information used to evaluate them. It is reported to be the first case alleging FCRA violations against an AI hiring tool.
