Detroit-based IT professional Arshon Harper filed a federal class action against Sirius XM Radio, LLC in the U.S. District Court for the Eastern District of Michigan, alleging the company’s AI-powered iCIMS applicant tracking system embedded historical hiring biases into candidate scoring. Harper says he applied to roughly 150 positions through the system and was rejected from all but one, despite a decade of IT experience. The complaint alleges the tool scored applicants using data points that proxy for race, such as educational institution, home zip code, and employment history, disproportionately disadvantaging Black candidates, and asserts claims of both intentional and unintentional discrimination under Title VII.
